Please find attached a copy of the incident report related to the investigation into video voyeurism allegations at Berean Baptist Church on Fleming Island.
In addition, a copy of the bill that amended 119.071, F.S. is attached. Please note that as of July 1, 2011, video voyeurism is considered and referred to as a sexual offense. Section 2 (page 3 of attachment) now prohibits the release of video/images of victims of video voyeurism. As such, this agency will not be releasing the video/images in evidence from this case/investigation for the reasons stated in Section 2. In addition, our agency now views, per the language used in the bill, video voyeurism victims as victims of a sexual offense and, as such, made redactions to the attached document under 119.071(2)h1.
As stated in the attached incident report, the state attorney's office decision is that a crime did occur but that it cannot be prosecuted due to the expiration of the statute of limitation. Our agency anticipates receiving a more detailed SAO disposition statement momentarily and will provide that to media outlets as soon as it is received. Please contact the SAO with any additional questions related to the SAO nol-pros decision.
